COMBERTON PARISH COUNCIL – Extraordinary Meeting

Wednesday 21 June 2006 in the Old Village Hall at 7.00pm

1. To approve apologies for absence and to receive declarations of interest from members

1.1 Apologies were received from Dr H Roscoe, Mr R Rowlands, Mrs A Webb and the Clerk.

1.2 Declarations of interest:

· There were no declarations of interest

2. Diversion of overhead electricity on land to north of recreation ground

2.1 Proposed route for the replacement of existing overhead electricity line

The meeting considered the relevant (non-confidential) input documents.[1]^,[2].

The meeting considered that it was important to discuss these inputs in more detail together with the confidential advice received from the Parish Council solicitors[3].

At 7.23pm on a proposition by the Chairman, carried unopposed, in accordance with S1(2) of the Public Bodies (Admissions to Meetings) Act 1960 in view of the confidential nature of the business to be transacted, that is the Council considering the confidential advice solicitors, the public were temporarily excluded from the meeting and were instructed to withdraw.

The meeting was re-opened at 7.45pm.

2.2 Proposed location for EDF transformer

Options for the location of the transformer were identified in the Clerk’s report.

On a proposition by Mr Hollick, seconded by Mr Charge it was unanimously resolved to select ‘Option 2’ as the preferred solution to locating the transformer, and to proceed with the works as soon as possible. (Remove pole and install the transformer in a 3x3m casing in between the garage and the skateboard park or near the bowling green supply. EDF will need to be deeded the ground on which the transformer sits, have 24x7 access rights and will cost upto £500 in legal fees).

2.3 Determining the value of the recreation ground extension for the land transaction return.

The meeting considered the input from PC solicitors on this and the calculation of the Stamp Duty Land Tax due[4]. The council did not identify any errors on the documentation prepared by Mr Stead, and were in agreement with his floccinaucinihilipilification regarding recreation ground land value. On a proposition by Dr. Chambers, seconded by Mr Morison, it was unanimously agreed to accept the solicitor’s advice and calculations (as prepared by Mr Stead) and return the prepared documentation in order to submit the return within 30 days of the effective date of the transaction.

There was no further business and the meeting closed at 8.00 pm
